Anti-Gun

Tim Kaine is a gun control advocate. He pushed gun control laws as mayor, governor, and DNC Chair and stooped to use the Tucson and Va Tech tragedies.

 

He was a radical who wanted to sue gun manufactureres and organized a statewide campaign when he was a Richmond councilman.

 

Later when he wanted to run for governor, he settled for being an obstructionist.  As governor he vetoed any significant firearm legislation when he knew a Democrat-controlled Senate would sustain his veto.

 

Even in face of legal problems in prosecuting the beltway snipers in Oct 2002, Kaine vetoed clarification and expansion of death-penalty statutes for these acts of terrorism. He would fully support Eric Holder's anti-gun agenda and never call for an investigation over Fast and Furious.

Allen has an A+ rating from the NRA. As governor he pushed through Virginia’s Concealed Carry Weapon laws and proposed federal legislation to harmonize Right To Carry reciprocity between states.

 

As senator he voted to:

 

  • Protect gun manufacturers from frivolous punitive lawsuits like Kaine wanted to promote
  • Oppose the so called “gun show loophole” regulations. Kaine tried to use the Virginia Tech Shootings to lobby for these regulations.
  • End the “assault weapons” ban. Kaine used the Tuscon shootings to lobby for resurrecting the ban and he has always held close ties with the Brady/Million Mom group as far back as Richmond.
  • Allow carrying concealed weapons in national parks where it is impossible to staff enough park rangers in remote areas.
  • Reinstate gun rights in the District which the Supreme Court upheld.

Tucson aftermath:

 

Two weeks after the Tucson shootings Kaine used the tragedy to advocate for gun controls.

 

Jumping on Sheriff Dupnik's (I hate Conservatives and concealed carry laws) bandwagon, Kaine couldn't resist in lobbying for Carolyn McCarthy's (NY Democrat) "assault weapons" ban.

Six people murdered, 13 wounded with an attempted political assassination. Why do we tolerate politicians and pundits who exploit tragedy?
Kaine's successor to the DNC Chair, Debbie Wasserman, immediately calls for universal screenings:

The DNC policy under Kaine in March was no doubt the same as Wasserman in April.

 

From Mayor to Governor
Kaine funded the Million Mom March:

 

Kaine funneled taxpayer funds to support the Million Mom March who support Brady laws. He equated his monetary support to routine legislative lobbying.

Offering monetary support to the more radical gun control organizations would seem shows that he fully supports their cause.

 

Kaine was later forced to return the money that he took from the city.

Thinks suing gun manufacturers would be effective:

Would a second amendment supporter use government to develop a strategy to use litigation to bankrupt gun manufacturers?

 

Politicians like Kaine forced Congress to pass the Firearms Manufacturers Protection bill.

I can't think of an issue I'd rather be aligned with than this:

 

Flanked by a group of gun-control activists on the steps of City Hall, Kaine said he will continue to promote what he called common-sense gun legislation.

"There is no issue in the city that is more important than gun violence, he said. My wife said to me the other day, sometimes you align yourself with an issue, and sometimes it aligns itself with you. I can't think of an issue I'd rather be aligned with than this".

 

Sarah Brady's organization endorsed Kaine in 2001.

Contemplates organizing state-wide gun control laws:
Councilman Timothy M. Kaine suggested that the city team up with Fairfax and Norfolk, the other major urban areas in Virginia, and push gun laws together.

Back in the Richmond days, Kaine was eager to lead gun control laws across Virginia.
Mark Warner's implies the NRA is un-American:

 

Kaine panders to rural Virginia like Mark Warner. You know Kaine's mentor who infamously said that

the NRA, home schoolers, and religious conservatives are "threatening to what it means to be an American."

It's fair to assume that both men on the Warner and Kaine ticket believed that the NRA was threatening.  Maybe someone could ask Kaine if he still agrees with Warner.  

 

And while you are at it, ask Kaine if he agrees that home schoolers threaten what it means to be American too.

Trying to reinvent himself during the senate race:

 

From Kaine's website on Dec 14, 2011 he claims support for the second amendment:

I am strong supporter of the Second Amendment, and I served as legal counsel to the effort to guarantee Virginians the right to hunt and fish.

This is a Kainetonian answer.  Representing someone does not mean that you agree with them.  "Hunt and fish" is different from defending constitutional gun rights.

 

His record as a politician is what matters.

Kaine uses Va Tech murders as a backdrop to propose new gun legislation:

 

The governor made the announcement standing with family members of students killed or injured in April's Virginia Tech shootings, as well as legislators and members of the law enforcement community.

"It is long past time to apply existing Virginia law to every firearm sale at a gun show," Kaine said. "It is wrong for felons, or domestic abusers constrained by protective orders, or people with serious mental illnesses who are likely to harm themselves or others to be able to buy a gun, and we must close this loophole."

 

The chairman of Kaine's Review Panel went on the say:

"I strongly believe that in today's world of automation there is no excuse for guns to be in the hands of those who are not eligible," Massengill said. "Closing this loophole at point of sale or transfer is a first step to ensure that only eligible individuals have the ability to purchase or possess firearms under Virginia law."
Even the Democrat Senate rejected his proposed bill.

 

Seung-Hui Cho did not purchase either handgun at a gun show.

 

If Kaine would visit a gun show, he would see an organized operation filled with responsible law abiding people. He will not see people sitting around looking to make so called private sales.

 

If Kaine had really wanted to address the root cause of this tragedy, then he should have fixed the problems in the Virginia education establishment that ignored so many red flags, over many years, from so many teachers, support personnel, and professors.

 

It is also disappointing to see a former head of the Virginia State Troopers use language like this is just "a first step". It sounds like Col. Massengill is from the same school as Pima County Sheriff Dupnik.  He doesn't say what the second and third steps should be.

Firearm Related Vetoes As Governor
HB370 - Sponsored by Carrico, 2006
Bill tried to clarify hunting local ordinances.
Passed House 99-0 and Senate 29-11. Senate then sustained the veto.
Kaine's Veto Reason: Lawyers have different opinions so we should study it.

 

Virginia's gun laws are confusing and they need to be simplified and harmonized as this bill demonstrated.  The 2012 Legislative Session is attempting to resolve some of those deficiencies.

HB1106/SB436 - Sponsored by Athey/Vogel, 2006
Bill would have added that "Any person who may lawfully possess a firearm and is carrying a handgun while in a personal, private motor vehicle or vessel and such handgun is locked in a container or compartment in such vehicle or vessel."
Passed House 70-24 and Senate 23-17. House (mainly NoVA) sustained the veto.
Kaine's Veto Reason: Firearms in locked containers or compartments should still require a concealed carry permit.

 

Q: What?  So I can't lock up a firearm but I can go to the range with it unlocked?

SB476 - Sponsored by Hanger, 2008
A person with a concealed permit can go into a restaurant, etc. where alcohol is available but they cannot consume any.
Passed House 62-36 and Senate 24-15. Senate sustained the veto 22-18. Similar bill brought up again as SB 1035 in 2009.
Kaine's Veto Reason: Allowing concealed weapons into restaurants and bars that serve alcohol puts the public, the employees, and our public safety officers at risk.

 

Q: So if you are single women with concealed carry permit to protect herself, then she can't go to the Olive Garden or most restaurants?

HB933/SB560 - Sponsored by Todd Gilbert/Mark Obenshain, 2008
Accessories, not just the triggerman, can be tried for first degree murder. This occured after the beltway sniper shootings where it could not be proved with forensics who committed each murder. The bill also anticipated the need to address terrorism and murder involving a continuing criminal enterprise.
Passed House 77-21 and Senate 24-16. House Overrode veto 76-24, Senate sustained veto 24-16.

 

The bills were brought up again in 2009 and Kaine vetoed them using the same reason.

Kaine's Veto Reason: Virginia is already second in the nation in the number of executions we carry out. While the nature of the offense targeted by this legislation is very serious, I do not believe that further expansion of the death penalty is necessary to protect human life. Accordingly, I am vetoing this bill.

 

Q: What is wrong with being #1?

 

We were close to not being able to convict John Allen Muhammad for capital murder until Lee Boyd Malvo testified against him.

 

Kaine led us to believe that he would keep his religious views on the death penalty private during the campaign.

HB1851 - Sponsored by Lingamfelter, 2009
Allows active duty service members of the United States Armed Forces or the Virginia National Guard to purchase more than one handgun within a 30-day period. This addressed the concern that military personnel were being rapidly deployed and they needed to protect their family. Passed House 86-13 and Senate 31-8. House Overrode veto 73-26, Senate sustained veto 26-14.

 

Senators who voted for Lingamfleter's bill and then flipped to sustain Kaine's veto:

  • Donald McEachin (D-Richmond/Henrico)
  • Mark Herring (D-Loudoun/Fairfax)
  • Charles Colgan (D-Manassass/Prince William)
  • George Barker (D-Fairfax)
Kaine's Veto Reason: Military can obtain a concealed carry permit if they want to make multiple purchases.

 

Military personnel cannot reasonably go through the CCW process (which can take 45 days) when they are in the process of being called up.  The military provides a unique service and should be granted latitude for needs like this.

 

Q: Do you think Kaine would stand by this if terrorists begin targeting military families while they are deployed?

HB2528- Sponsored by Cole

 

Counties can't offer money for surrendering a firearm and they must attempt to recover funds by selling them to licensed dealers instead of simply destroying them. (In other words, we don't like Washington D.C.'s process)
Passed House 85-11 and Senate 28-12. House Overrode veto 71-28, Senate sustained veto 24-16.

Kaine's Veto Reason: A standard procedure is not needed.

 

You don't usually see a politician turning down an opportunity to reclaim money.

 

Bills Signed


Kaine signed the following bills. These bills were restrictive in nature, or dealt with fees, permits, exceptions for officials.  Kaine did nothing to reduce government restrictions over gun ownership.

 

  • HB1577 Concealed handgun permits; renewal rules.
  • HB255 Line of Duty Act; mandatory training required for employees covered thereby.
  • HB260 Hunting or trapping in state forests; increases fees to obtain permit.
  • HB1988 Concealed weapons; officer of State Police to carry while on active duty with reserve forces.
  • HB2308 Model firearms hunting ordinances; locality may adopt those developed by Board of Game, etc.
  • HB2309 Shotguns; eliminates certain requirements for hunting migratory game birds.
  • HB1414 Concealed handgun permits; revocation upon notification of State Police.
  • HB529 Concealed handgun permits; renewal and replacement thereof.
  • HB709 Firearms; person legally incompetent, etc. prohibited from purchasing, possessing or transporting.

As citizens it is ultimately our responsibility to protect ourselves. The best that law enforcement can do is investigate crimes after the fact, minimize repeat offenders, and create a belief that laws will be enforced.
